1. Terms and conditions of use (last revision: July 8, 2021)

Welcome to SoundPure.com, the web-based portion of Sound Pure LLC (hereinafter referred to exclusively as "SoundPure.com"). These terms and conditions will govern your purchases made online at SoundPure.com and any of your purchases made through email, telephone, mail, in person, or any other communications with a representative of SoundPure.com. If you visit www.soundpure.com, or shop with SoundPure.com, you accept these conditions as they are today, and as they may change from time to time. Please read them carefully. In addition, when you use any current or future SoundPure.com service or visit or purchase from any business affiliated with SoundPure.com, whether or not included in the SoundPure.com Web site, you also will be subject to the guidelines and conditions applicable to such service or business. If these conditions are inconsistent with such guidelines and conditions, such guidelines and conditions will control.

2. Privacy

Your use of the SoundPure.com website is governed by the Privacy policy contained in our Privacy notice (link available at the bottom of the webpage) which is subject to change from time to time. Please review our Privacy notice regularly, which governs your visit and any information gathered by or exchanged with SoundPure.com.

3. Electronic communications

When you visit SoundPure.com or send emails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by email or by posting notices on this site. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

All content included on this site, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of SoundPure.com or its content suppliers and protected by United States and international copyright laws. The compilation of all content on this site is the exclusive property of SoundPure.com and protected by U.S. and international copyright laws. All software used on this site is the property of SoundPure.com or its software suppliers and protected by United States and international copyright laws.

5. Trademarks and other intellectual property

SoundPure.com's trademarks and trade dress may not be used in connection with any product or service that is not SoundPure.com's, nor in any manner that is likely to cause confusion among customers or in any manner that disparages or discredits SoundPure.com. All other trademarks not owned by SoundPure.com or its affiliates that appear on this site are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by SoundPure.com or its affiliates.

6. Licensing and site access

SoundPure.com grants you a limited license to access and make personal use of this site and not to download (other than page caching) or modify it, or any portion of it, except with express written consent of SoundPure.com. This license does not include any resale or commercial use of this site or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of this site or its contents; any downloading or copying of account information for the benefit of another merchant; or any use of data mining, robots, or similar data gathering and extraction tools. This site or any portion of this site may not be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without express written consent of SoundPure.com. You may not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of SoundPure.com and our affiliates without express written consent. You may not use any meta tags or any other "hidden text" utilizing SoundPure.com's name or trademarks without the express written consent of SoundPure.com. Any unauthorized use terminates the permission or license granted by SoundPure.com. You are granted a limited, revocable, and nonexclusive right to create a hyperlink to the home page of SoundPure.com so long as the link does not portray SoundPure.com, its affiliates, or their products or services in a false, misleading, derogatory, or otherwise offensive matter. You may not use any SoundPure.com logo or other proprietary graphic or trademark as part of the link without express written permission.

7. Your account

If you use this site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. SoundPure.com does sell products for children, but it sells them to adults, who can purchase with a credit card. If you are under 18, you may use SoundPure.com only with involvement of a parent or guardian. SoundPure.com and its affiliates reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in their sole discretion.

8. Reviews, comments and other communication

Visitors may post reviews, comments, and other content; and submit suggestions, ideas, comments, questions, or other information, so long as the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties or objectionable and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of "spam." You may not use a false email address, impersonate any person or entity, or otherwise mislead as to the origin of a card or other content. SoundPure.com reserves the right (but not the obligation) to remove or edit such content, but does not regularly review posted content.

If you do post content or submit material, and unless we indicate otherwise, you grant SoundPure.com and its affiliates a nonexclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media. You grant SoundPure.com and its affiliates and sublicensees the right to use the name that you submit in connection with such content, if they choose. You represent and warrant that you own or otherwise control all of the rights to the content that you post; that the content is accurate; that use of the content you supply does not violate this policy and will not cause injury to any person or entity; and that you will indemnify SoundPure.com or its affiliates for all claims resulting from content you supply. SoundPure.com has the right but not the obligation to monitor and edit or remove any activity or content. SoundPure.com takes no responsibility and assumes no liability for any content posted by you or any third party.

9. Registration

Certain sections of, or offerings from the Site may require you to register. If registration is requested, you agree to provide us with accurate, complete registration information. Your registration must be done using your real name and accurate information. Each registration is for your personal use only and not on behalf of any other person or entity. We do not permit (a) any other person using the registered sections under your name; or (b) access through a single name being made available to multiple users on a network. You are responsible for preventing such unauthorized use.

10. Third party content

Third party content may appear on the Site or may be accessible via links from the Site. We are not responsible for and assume no liability for any mistakes, misstatements of law, defamation, omissions, falsehood, obscenity, pornography or profanity in the statements, opinions, representations or any other form of content on the Site. You understand that the information and opinions in the third party content represent solely the thoughts of the author and is neither endorsed by nor does it necessarily reflect our belief.

11. Forms, agreements, documents

We may make available through the Site or through other Web sites sample and actual forms, checklists, business documents and legal documents. All Documents are provided on a non-exclusive license basis only for your personal one-time use for non-commercial purposes, without any right to re-license, sublicense, distribute, assign or transfer such license. Documents are provided for a charge and without any representations or warranties, express or implied, as to their suitability, legal effect, completeness, currentness, accuracy, and/or appropriateness. THE DOCUMENTS ARE PROVIDED "AS IS", "AS AVAILABLE", AND WITH "ALL FAULTS", AND WE AND ANY PROVIDER OF THE DOCUMENTS DISCLAIM ANY WARRANTIES, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

12. Copyright complains

SoundPure.com respects the intellectual property of others. If you believe that your work has been copied in a way that constitutes copyright infringement, please contact us at SoundPure.com.

13. Product descriptions and photographs

SoundPure.com and its affiliates attempt to be as accurate as possible. However, SoundPure.com does not warrant that product descriptions or other content of this site is accurate, complete, reliable, current, or error-free. If a product offered by SoundPure.com itself is not as described, your remedy is to return it in unused condition for a refund. SoundPure.com makes every effort to accurately represent items by photograph, but you agree that color discrepancies are typical across various computer viewing screens and printers, and that such color discrepancies are not grounds for a refund, other than those allowed by the official SoundPure.com return policy as it pertains to non-defective items.

14. Sales policy

Unless otherwise clearly noted on the specific items product page, all items listed at SoundPure.com are BRAND NEW and carry the FULL MANUFACTURER WARRANTY, which varies completely from manufacturer to manufacturer, and even from product to product. All warranty claims are between you the purchaser, and the original manufacturer of the good. Items received DOA (dead on arrival), that fail, or that are otherwise determined defective within the first thirty (30) days, may alternatively be handled through the below RETURN POLICY. Except as otherwise provided by the manufacturer warranty agreement, you are responsible for any shipping costs to and from the manufacturer for warranty repairs.

All returns and cancellations are subject to this entire agreement including the below return policy and its provisions concerning special order items.

Sound Pure requires "cleared" prepayment before any goods will leave the facility, and reserves the right to cancel any order, and return payment at any time and for any reason. Cleared prepayment includes payment by all check methods including cashier's check, money orders, personal checks, as well as bank wires, or credit card prepayment that have gone through any security steps deemed necessary by SoundPure.com to prevent and deter fraud.

15. Sales tax

SoundPure.com is required to collect sales tax only for items delivered to addresses in the following states . Note, these listed states are subject to change at any time, and sales tax is charged at the time your order is fulfilled in-full.

If your delivery address is inside any of these states, or your purchased item is picked up at our North Carolina address, we are required by law to charge Sales Tax. If we ship to your location outside of these listed states, we will not collect any sales tax from you.

SoundPure.com makes no claims with regard to whether you may be liable for Sales Tax in the State or Country where the product is shipped, or where you later bring or carry it, only that SoundPure.com will NOT collect Sales Tax if shipping to a location outside of these listed states.

For the list of states where we do collect tax, Sales Tax will be added to your product total at the time of order fulfillment.

16. Payment policy

You represent and warrant that if you are purchasing something from us that (1) any credit information you supply is true and complete, (2) charges incurred by you will be honored by your credit card company, and (3) you will pay the charges incurred by you at the posted prices, including any applicable taxes and shipping charges. You also agree that you will be responsible for any legal and collection fees associated with any failure to pay or fraudulent representations.

17. Shipping: damaged goods, risk of loss, delays, in transit cancellations advance replacements, proper packaging

It is our recommendation that you DO NOT SIGN FOR A PACKAGE if you suspect that the contents have sustained damage, simply REFUSE these items, or require that the driver allow you to inspect the contents and approve their condition, prior to signing for any package. You can alternatively have the shipping agent provide you with a release, in writing, describing the damage that will allow you to inspect the items after the delivery has been made. While signing for a package does not necessarily eliminate your ability to make an insurance claim, it could limit the availability of such a claim, as all items are subject to the shipping contract provided by the carrier that you choose. You must RETAIN ALL ORIGINAL SHIPPING CONTAINERS AND PACKING MATERIALS, or your insurance claim will be REFUSED. You must inspect packages received immediately upon receipt, and report any damage to both SoundPure.com and the shipping carrier immediately. Any delays in reporting damage may result in refusal of your insurance claim by the shipping carrier.

All items purchased from SoundPure.com are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon SoundPure.com's relinquishment of the goods to the carrier of choice. Any claim against the carrier is the sole responsibility of you, the purchaser. SoundPure.com requires and places on your behalf, ample insurance for all items that it ships. If an item is lost or damaged by the carrier while under the carrier's control, Soundpure.com will make every reasonable effort on your behalf for a speedy recovery of insurance proceeds, lost items, or product replacement if so desired by you. While this policy explains SoundPure.com's efforts on your behalf, the shipping insurance claim process and any other aspect of the shipping contract is governed by the shipping contract with the individual carrier, and not by SoundPure.com.

Carrier delays do happen, and these delays are outside the control of Sound Pure. During peak (and pandemic) seasons, delays in deliveries, and even extended periods of no scans by the carriers can and do occur. This does not automatically mean your package is lost - if you are concerned about your package, contact your Sound Pure sales representative who can initiate a trace after several days without a scan update. Should you wish to cancel an order that is in transit, whether or not a package is delayed, you will be held responsible for the shipping charges associated, unless those charges are refunded by the carrier due to carrier error/issue. A refund for the product itself, will always be issued once one of three situations have occurred: 1) Item is safely returned to Sound Pure, 2) Item is officially reported as lost by FedEx, 3) A Return to Sender (RTS) is initiated by Sound Pure, and the item is confirmed by trace or tracking to be moving back in the direction of Sound Pure. In all cases, the customer bears the full financial responsibility of the item, if it is delivered, until it is returned to Sound Pure, regardless of whether or not a refund has been issued. Customers must comply with all claims, insurance, and/or carrier pickup processes including returns, and safe/acceptable repackaging, or else they are financially responsible for the merchandise.

Should a replacement be desired by you while awaiting the results of an insurance claim with the shipping carrier, and a replacement is available, the CUSTOMER WILL BE RESPONSIBLE FOR PAYMENT OF ANY ADVANCE REPLACEMENT prior to receipt of any insurance proceeds from the shipping carrier. Should SoundPure.com handle an insurance claim on behalf of you, or should the carrier send the insurance proceeds to SoundPure.com, SoundPure.com will promptly refund the money for the original purchase price, once it successfully resolves an insurance claim and receives the full insurance amount from the insurance adjustment.

Proper Packaging is Required for all shipments originating from customers. This includes shipping returns, shipments to Sound Pure for trade-in or consignment, and shipments to manufacturers or third parties for repair, returns, or service. Sound Pure is not responsible for shipping damage when the item(s) shipped by the customer are insufficiently, or incorrectly packaged. Sound Pure carries full insurance for all labels issued by Sound Pure and/or shipped on designated Sound Pure shipping accounts, as long as items are properly and adequately packed/protected for shipping. Please note, however, that insufficient packaging is the most common denial of claim by shipping carriers and insurers when denying a claim due to damage while in-transit. If in doubt, please contact Sound Pure for details around proper shipping methods to ensure the safe delivery of your package.

18. Return policy

A. Overview

The following return policy shall apply to all items purchased online from SoundPure.com, or by telephone, email, or in-person contact with a Sound Pure representative.

If you object to any aspect of this return policy, or would like to request a special deviation from the policy, you must handle such request directly with a Sound Pure representative, and you MUST HAVE SPECIFIC WRITTEN APPROVAL (email is acceptable) OF ANY DEVIATION FROM THIS POLICY BY AN AGENT OF SOUNDPURE.COM BEFORE MAKING THE PURCHASE, otherwise you are bound by this return policy as it is stated here.

No refunds will be allowed for items that have been damaged, marked (superficial or otherwise), misused, are missing documentation or packaging, have been altered, modified, or tampered with, or in any other way differ from a product in mint, as-new condition.


B. Sound Pure's Try-Before-You-Buy

Sound Pure's unique Try-Before-You-Buy program enables a customer to try out products without committing to a purchase. To qualify for the program, you must contact a sales representative - online orders are not eligible for the program. The sales representative will qualify your purchase (ensure it is the right product for your needs), and ship it out to you. A credit card authorization (hold) is required, for the full amount (but is not charged). This places a temporary hold on the funds (will restrict your limit on a credit card, and reduce your available funds if a debit card), but will not hit the credit card statement. If you decide to keep it, your card will simply be charged.

If you decide to return the item, you are only responsible for paying the shipping costs (both directions). You will have 7-days from the arrival to contact your Sound Pure sales representative, otherwise, your credit card will be charged. If more time is required, you MUST call for an extension and it will often be granted. Like all returns, Try-Before-You-Buy returns must be received in as-new, showroom condition, with all inserts, packaging, and contents. Any "Try Before You Buy" marked item that is NOT returned in showroom condition, or is missing any original packaging, inserts, or materials is subject to a minimum restocking fee of 15% (additional fees will apply where damage or missing items exceed 15% of the value of the item). Sound Pure reserves the right to reject returns (no refund granted) in its sole discretion, if there is any damage or missing materials.


C. Automatic 48-Hour Approval Period

All items labeled as eligible for "Try Before You Buy" on their product page get an automatic 48-hour approval period. This is true for items purchased online, by phone, or in-store. To return an item for a full refund, you must contact Sound Pure within 48-hours of receiving the item, and receive an RA-Number from a Sound Pure representative. If more time is required for you to make a decision, you MUST call to request an extension. Buyer is responsible for the actual shipping and insurance costs both ways. All items must be returned in showroom condition with all original packaging and contents.

Any "Try Before You Buy" marked item that is NOT returned in showroom condition, or is missing any original packaging, inserts, or materials is subject to a minimum restocking fee of 15% (additional fees will apply where damage or missing items exceed 15% of the value of the item). Sound Pure reserves the right to reject returns (no refund granted) in its sole discretion, if there is any damage or missing materials.


D. 14-day Return Policy for All Other Items (Items Not Marked as eligible for "Try Before You Buy"), and for Items That are Returned after the Approval Period or after Try-Before-You-Buy window

This section of the Return Policy applies to any product that is NOT marked as "Try Before You Buy" on the product page at the time of their purchase, and any product that is held beyond the 48-hour Approval or Try-Before-You-Buy period. In such cases, these products are ONLY eligible for Exchanges (for Store Credit), or are subject for a 15% restocking fee. In any case, the intention to make the return must be made to a Sound Pure representative within 14 calendar days from the original date of delivery to the customer or a return may not be granted. Shipping costs will be deducted from any credit issued - the Customer is responsible for the shipping costs in both directions, whether or not an exchange (Store Credit), or Partial Refund (Purchase price less any applicable restocking fee) is requested.

All items returned for ANY reason, must be returned in perfect as-new cosmetic condition, with all original packaging, books, materials, etc. intact, and within 14 days of receipt of the product. Items returned must be given a return authorization (RA) number by a SoundPure.com employee, and must be amply packed and fully insured. You will be responsible for the shipping charges both ways, even if item was originally purchased under a free shipping promotion, and you will be refunded the remaining 85% balance after SoundPure.com has inspected the item and it meets the above conditions.

SoundPure.com will waive the restocking fee, but not the shipping charges, so long as the item is a regularly stocked item (not a special order), and you are willing to place the complete credit towards another purchase at SoundPure.com. The condition of the returned item must also meet the above condition to be accepted, and if you are uncertain as to whether or not an item is regularly stocked at SoundPure.com it is your responsibility to verify such information prior to placing an order.


E. Special order items

Any "special order" item will be clearly indicated by a SoundPure.com employee at the time of order or shall be clearly noted "Special Order" on the SoundPure.com website. Items labeled "Special Order" are not normally stocked by Sound Pure, and are therefore NOT RETURNABLE FOR ANY REASON, and once an order is placed these SPECIAL ORDER ITEMS ARE NOT CANCELLABLE. Special Order items may require a 20% or more non-refundable deposit at the time your order is placed. Deposits and Payments made on Special-Order items are not eligible for refunds, exchanges, or credits.

If a "Special Order" item is received by the customer with a material defect, Sound Pure will work with the client to resolve the issue with the manufacturer, and will repair or replace the item, depending on the manufacturer's decision. To the extent that the manufacturer will issue a refund to Sound Pure for the defective special-ordered product, this refund option will be made available to the customer.


F. Defective items and DOA (Dead On Arrival) items

Any "defective" item is fully refundable including any shipping costs. The customer is not responsible for shipping cost in either direction. SoundPure.com may require that the item be shipped directly to the manufacturer, or returned to SoundPure.com. Contact SoundPure.com immediately regarding any potential defect you find. You must receive an RA (Return Authorization) for any item that is returned to SoundPure.com, and shipping instructions. A full-refund or product-replacement will be issued only after the item has been verified defective. In order to qualify for a refund or replacement, the defective item must be returned to SoundPure.com in otherwise perfect mint, as-new condition, with all original packaging, books, materials, etc. intact, and within 30 days of receipt of the product.

If a replacement is available, the replacement will be shipped at no additional cost to the customer once the defective item has been returned to SoundPure.com or the product manufacturer and is verified to be in the above stated condition. Alternatively, an advance replacement may be shipped to the customer if one is available, however, the CUSTOMER WILL BE RESPONSIBLE FOR PLACING A CREDIT CARD HOLD FOR THE COST OF ANY ADVANCE REPLACEMENT. The card will not be charged for the advance replacement unless the defective unit is not returned (to SoundPure, or the product manufacturer) in the above stated condition within 30 days.

19. Pricing policy

Despite our best efforts to maintain accurate pricing on our website, some items on our website may be incorrectly priced, and therefore we cannot confirm the price of an item until we receive your order. In some cases, we will not be aware of a change in price because we were not informed by the manufacturer who made such a price change, and therefore only become aware of such change when we try to place an order on a customer's behalf using the previous and incorrect pricing provided to us by the manufacturer. In some cases pricing may have simply been entered into the site or computed in error.

By visiting this site you understand and agree that prices are subject to change, and that you will not hold SoundPure.com liable for incorrect pricing on the SoundPure.com website. While unlikely, you also agree that even after you place an order with the website, if the price is incorrect, SoundPure.com reserves the right to decline such an order, and refund any payment received. If an item's correct price is higher than our stated price at the time you place an order on our website, we will contact you for your instructions and confirmation prior to shipping an item.

While SoundPure.com reserves the right to cancel an order at any time due to a pricing error, you will never be charged a price higher than the quoted price on our website at the time of your checkout, without your verbal or written authorization.

20. Stock policy

Sound Pure makes every effort to ensure up to date stock information, and delivery information. However, mistakes can be made, and items may sell out prior to the website updating. At times, an item can sell out sometimes even after an item has been added to your cart. If the stock situation or delivery situation differs materially from that which is stated on the website, SoundPure.com will notify the customer promptly and provide them the opportunity to cancel the order. SoundPure.com relies on the information provided to it from its various suppliers regarding item availability, and backorder time estimates and makes no guarantee or warranty about the stock status of any item represented on SoundPure.com.

21. Quotebacks prices

SoundPure.com Quotebacks are private, confidential email communications to be used exclusively between SoundPure.com and its legitimate, bona fide customers. Quotebacks may not be provided to our competitors, nor used in any way to seek quotes with our competitors. Quotebacks may not be requested by our competitors, or any other party seeking the confidential pricing information that SoundPure.com makes available to its customers. By requesting a Quoteback from our site, you agree that you are a legitimate potential customer, seeking pricing information in contemplation of a purchase from SoundPure.com.

All SoundPure.com prices, including Quoteback prices, are subject to change at any time. You must verify and accept the price listed in your shopping cart, prior to checkout, regardless of the quoteback price that you received. It is possible that a link contained in a Quoteback to "add item to shopping cart" will work, even though a price change has occurred. It is your sole responsibility to verify and accept the prices in your shopping cart prior to submitting payment.

22. Disclaimer of warranties and limitations of liability

This site is provided by SoundPure.com on an "as is" and "as available" basis. SoundPure.com makes no representations or warranties of any kind, express or implied, as to the operation of this site or the information, content, materials, or products included on this site. You expressly agree that your use of this site is at your sole risk.

To the full extent permissible by applicable law, SoundPure.com disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. SoundPure.com does not warrant that this site, its servers, or email sent from SoundPure.com are free of viruses or other harmful components. SoundPure.com will not be liable for any damages of any kind arising from the use of this site, including, but not limited to direct, indirect, incidental, punitive, and consequential damages.

23. Indemnification

User agrees to indemnify and hold each SoundPure.com Provider harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of such User's breach of the Terms of Use or User's violation of any law or the rights of a third party.

24. Applicable law

By visiting SoundPure.com, you agree that the laws of the state of North Carolina, without regard to principles of conflict of laws, will govern these Conditions of Use and any dispute of any sort that might arise between you and SoundPure.com.

25. Disputes and arbitration

Any dispute relating in any way to your visit to SoundPure.com or to products you purchase through SoundPure.com shall be submitted to confidential arbitration in Durham, North Carolina, except that, to the extent you have in any manner violated or threatened to violate SoundPure.com's intellectual property rights, SoundPure.com may seek injunctive or other appropriate relief in any state or federal court in the state of North Carolina, and you consent to exclusive jurisdiction and venue in such courts. Arbitration under this agreement shall be conducted under the rules then prevailing of the American Arbitration Association. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.

26. Site policies, modification, and severability

Please review our other policies posted on this site. These policies also govern your visit to SoundPure.com. We reserve the right to make changes to our site, policies, and these Conditions of Use at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.

27. Sound Pure's Free, 3-Year Parts & Labor Warranty Program for New Products

Sound Pure's Free, 3-Year Warranty applies to all brand new products that are that are marked with the 3-year warranty on the products page, at the time of purchase. The warranty covers BOTH PARTS AND LABOR! The Sound Pure Warranty Coverage extends for three years from the time of purchase. We are here to help you above-and-beyond the call-of-duty, when you encounter problems, and this warranty makes Sound Pure's legendary, industry-leading service and support that much more "official!"

Our warranty does not in any way negatively affect your manufacturer warranty for the product that you purchase. Sound Pure's warranty serves as a serious, parallel warranty, that will extend beyond the manufacturer warranty, should it end prior to three years time. To be eligible for Sound Pure's Free 3-Year Warranty, you must first have registered your product with the manufacturer. While some manufacturer warranties are transferable to other owners, Sound Pure's Free 3-Year Warranty is only available to the original purchaser from Sound Pure (non-transferable).

Unlike some of our competition that attempt to do "in house" technical repairs on high-end products (including electronics), Sound Pure strongly believes that the manufacturers of the products that we carry are best equipped to deal with problems as they arise. The original product manufacturer remains Sound Pure's "first choice" for warranty and out-of-warranty repairs, in general, although other repair facilities may be determined more practical, and the ultimate warranty provider shall remain in Sound Pure's sole discretion. Notwithstanding any manufacturer warranty to the contrary, you will be responsible for all shipping costs to and from the manufacturer, or any other location determined by Sound Pure, where the repairs will be made. Should the repair be deemed "not covered" (for example if it is determined that water damage was the result of the problems you encountered) you will be responsible for any diagnostic labor costs charged by the repair facility.

Nothing here prevents you from dealing with the manufacturer directly in seeking their warranty coverage (or any non-covered repair), and this shall not negatively impact your warranty coverage under Sound Pure's warranty program.

When you encounter a warranty issue that you want covered under Sound Pure's Free, 3-Year Warranty, simply contact Sound Pure directly to initiate the warranty repair under this program. Do not send the product to the manufacturer, or any other repair destination, until you have been instructed to do so by Sound Pure. You will be provided specific and explicit instructions to ensure your claim and repair is handled as smoothly and efficiently as possible. Sound Pure will do our best to get your gear returned to you as quickly as possibly, however, we will not be liable for any incidental or consequential damages including but not limited to lost wages, lost studio time, lost work, lost data, nor any emotional, or other ancillary issues created when a piece of equipment encounters issues, or during the time it is sent for repair under this warranty.

This Warranty only applies to items sold in brand new condition. It does not apply to products that are marked or listed as used, demo, open-box, consignment, floor-model, etc. unless a specific written exception is provided by a Sound Pure employee prior to the time of purchase. Purchases made from Sound Pure LLC on affiliate sites such as Amazon, eBay, Indoorstorm.com are not eligible for the warranty. Only purchases of new products made on SoundPure.com, or by calling a Sound Pure representative, are eligible for the warranty.

Sound Pure's Warranty does NOT provide "no fault" coverage. We will always do our best to help you regardless of your circumstances, however, this coverage only applies to product issues resulting from normal operations in normal and accepted operating conditions. Products modified in any way are not covered by this warranty.

Issues resulting from any sort of abuse, damage, act of god, water or liquid-spill damage, or failure to maintain the equipment in normal operating conditions are not covered under this warranty. Certain items such as acoustic instruments, and acoustic guitars in particular, should be stored in humidity-controlled environments, and never exposed to extremes of heat, moisture, or dryness. This warranty does not cover products that have been modified, in any way. Cosmetic issues are not covered under this warranty, and include things such as (but not limited by) subjective tonal-related complaints, finish-related issues including cosmetic signs of age, sun-fading, peeling of labels/silk-screening/tolex/grill-cloth. "Setup" related issues on instruments are not covered, such as instrument neck adjustments (seasonal or otherwise), and fret wear.

Certain items are not covered under this warranty. This includes drums and related hardware are covered for manufacturing defects, but not for abuse, wear and tear, nor damage. Cymbals are not covered under this warranty. Software of any kind, and in any form, is not covered. Hard drives, and any data recovery, and any data loss resulting from faulty hard drives is not a service covered by the warranty. Surge protectors and power conditioners are covered under this warranty should they become defective, but this warranty does not cover the cost, repair, or replacement due to damage associated with equipment being connected to a defective surge protector or power conditioner covered under this warranty. "Consumable" items are not covered under this warranty, whether they be a consumable device, component, accessory, or part. An inconclusive list of consumable items not covered include bulbs, vacuum tubes, batteries, strings, drum heads, tape heads; other items that simply "wear out" whether due to abuse or just heavy regular use rather than manufacturing defect, such as deterioration or failure of plugs/jacks/pots, and threaded components (such as threaded parts on stands and mounts), and other components with known limited life-cycles; analog vu meters, motorized components such as flying faders, speaker cones/drivers, spring-loaded reverb tanks, microphone ribbon-elements; any other items that are specially excluded or limited in duration (or coverage) within the manufacturer within the manufacturer's own warranty program, such as items that are specifically limited to only 90-day coverage in an otherwise 1-year manufacturer warranty. While Sound Pure cannot cover "consumable" items or accidental damage, we will still go out of our way to make sure you are back up and running at the least possible cost, and as quickly as possible.

Sound Pure wishes to offer you the best support, coverage, and overall buying experience of any company in the industry, which is why this warranty has been created. Because of the nature of this special warranty, we do not want to fall victim of abusive or dishonest behavior, therefore Sound Pure reserves the right to refuse or reject products presented for this warranty program at our discretion, and reserves the right to modify (at any time) the conditions governing this warranty. To the same degree, remember Sound Pure will always do our best to help you out, even if you encounter issues outside of this three-year warranty coverage, even after three years! Know you are in the best possible hands when you do business with Sound Pure.

The Sound Pure warranty is effective beginning on November 30, 2012. Products purchased prior to November 30, 2012 are not officially eligible, however, Sound Pure will always do our best to help our customers when they encounter problems, even outside of the coverage period.
